Switzerland offers one of the most secure legal frameworks in the world for protecting intellectual property, making it an attractive jurisdiction for both local and international businesses.

With SIGTAX, you can protect your trademark in Switzerland efficiently and compliantly—even without being physically present in the country. Our experts guide you through the process of Trademark Registration in Switzerland from application to approval, ensuring your brand remains protected under Swiss and international law.

Swiss Trademark Protection Process

The Swiss Federal Institute of Intellectual Property (IPI) oversees trademark applications and registration. Eligible trademarks include words, letters, slogans, logos, images, colors, shapes, and 3D objects, provided they are distinctive, non-descriptive, and compliant with public order standards.

Note: Before applying, it’s important to verify your proposed trademark’s uniqueness and ensure it is not offensive or contrary to Swiss values. The IPI provides resources to check for similar trademarks and assess potential objections. SIGTAX helps navigate the IPI trademark process with ease.

The trademark process includes:

1. Application Review

Once submitted and a claim is validated, the protection process begins, typically within six working days. Trademark protection requires the sign to be graphically represented and clearly distinguish your goods or services. Words, letters, slogans, logos, images, colours, shapes, and three-dimensional objects are all eligible. Marks must be distinctive, non-descriptive, and comply with public order standards.

2. Publication Period

After approval, maintaining the protected status ensures your rights are safeguarded under Swiss law. International agreements also allow extending protection at the EU level. During the process, trademarks are published in the Official Gazette to allow for objections. This publication period can take up to three months.

3. Final Approval

If no counterclaims arise, a Swiss trademark certificate is issued within six months. Fast-track options are available for quicker approval.
If a refusal or objection arises, applicants have five months to resubmit with modifications.
